H-RERA Gurugram Inspects 8 Under-Construction Projects

The Real Estate Regulatory Authority (RERA) of Gurugram carried out inspections on eight under-construction real estate projects. These projects, which include notable developments like Signature Global Prime, Micasa, Waterfall Residences, Signature Global Proxima 1, SS High Point, Signature Global City, Godrej Meridien Phase II, and Eminence Kimberly Suites, are strategically located along the key Southern and Northern Peripheral Roads of Gurugram.

The primary focus of these inspections was to evaluate the progress and compliance of these projects with their regulatory requirements. Arun Kumar, the Chairman of RERA Gurugram, who assumed his role in December of the previous year, led the inspections. This scrutiny is part of the authority’s efforts to ensure that these developments meet their extended deadlines for completion and are prepared to hand over units to the allottees.

According to RERA's mandate under Sections 6 and 7(3) of the RERA Act 2016, these projects are eligible for an extension if the developer faces unforeseeable delays due to force majeure or other significant hindrances. Such extensions are granted upon application by the promoter, accompanied by a stipulated fee. The intention behind these extensions is not just regulatory compliance but also to safeguard the interests of the homebuyers ensuring they receive their homes within the revised timelines.

During the inspections, it was observed that despite the granted extensions, several projects had not made satisfactory progress. This has been a critical issue, as Arun Kumar had previously identified and examined 35 under-construction projects in April to assess their actual construction progress. The ongoing evaluation revealed that construction was still active even after the expiration of the originally stipulated time frames, which had initially been set by RERA at the time of issuing the projects' registrations under Section 5.

Furthermore, it was noted that promoters had created third-party rights three to four years ago, complicating the timely completion of these projects. The delay in construction affects not only the timeline but also the financial and living arrangements of future residents.

RERA’s current assessment will influence the future granting of extensions under Section 6 and 7(3), ensuring that such leniencies are justified and lead to the completion of projects. The authority remains vigilant, prioritizing transparency and accountability, to uphold the rights of the allottees and maintain trust in Gurugram's real estate sector.

The RERA’s proactive approach under Arun Kumar’s leadership marks a significant step towards regulating the real estate environment in Gurugram, emphasizing both developer accountability and consumer protection.
