Bihar RERA Issues Arrest Warrants Against Builders for Refund Defaults

The Real Estate Regulatory Authority (RERA) Bihar has issued arrest warrants against the directors of three construction companies for failing to refund a total of approximately Rs 21 lakh to three homebuyers. The decision was taken by RERA chairman Vivek Kumar Singh after the builders ignored previous orders directing them to return the amounts to the aggrieved buyers.

One of the cases involved Gopal Swaroop Ravi, who had filed a complaint seeking a refund of Rs 3.5 lakh. The case was initially settled in March 2023, with the builder being ordered to return the amount. However, after the builder failed to comply, Ravi filed an execution case in January 2024, leading to the recent warrant.

Another case was filed by Suresh Narayan Singh, who had been awaiting a refund of Rs 10 lakh. RERA settled his case in January 2024, issuing an order for the builder to pay the due amount. When the builder failed to adhere to the ruling, Singh filed an execution case in June 2024. Despite the legal directive, the builder did not refund the amount, prompting the authority to take stringent action.

The third case was filed by Dinesh Kumar, who was entitled to a refund of Rs 7.84 lakh. His case was resolved in August 2023, with an order for the builder to return the sum. However, when the builder did not comply, Kumar pursued legal action by filing an execution case in September 2024.

RERA's decision to issue arrest warrants reflects the authority’s strict approach toward ensuring compliance with its orders. The purpose of these warrants is to enforce accountability among builders and protect the interests of homebuyers who have invested in real estate projects.

Homebuyers often face difficulties in recovering their investments when builders fail to deliver on promises.
