The Telangana Real Estate Regulatory Authority (TGRERA) has imposed penalties on three developers for project delays and violations of the Real Estate (Regulation and Development) Act, with orders issued on September 29. The decisions came after complaints from homebuyers who alleged non-delivery of projects, lack of refunds, and marketing without registration.
In the first case, homebuyers Sumit Kumar Soni and Ranjana Bansal from Gachibowli filed a complaint against Jayathri Infrastructures Pvt Ltd over the ‘Sky Exotica’ project at Gopanpally. They stated that despite paying ₹30 lakh, they neither received a refund nor an allotment, and construction did not commence. TGRERA directed the promoter to refund the entire amount with 10.8% annual interest from the date of the MoU until repayment, within 90 days. The authority also levied a penalty of ₹18.3 lakh under Section 59 of the Act for marketing flats without project registration. The penalty amount must be deposited into the TGRERA fund within 30 days.
The second case was filed by Shiva Shankar Reddy against Sunrise Constructions of Ramachandrapuram for the ‘Sunrise Abode’ project. The complainant said he had spent nearly ₹55 lakh, including loan and registration charges, on a flat priced at ₹67.2 lakh but possession was not given despite assurances in October 2022. The authority directed the promoter to execute and register the sale deed for Flat No. 411 within 30 days, subject to payment of the remaining amount by the buyer. In addition, a penalty of ₹5 lakh was imposed under Section 60 for failing to meet disclosure requirements under Section 4(2)(l)(D).
In the third case, Anuparthi Sandhya Rani from Uppal lodged a complaint against Krithika Infra Developers regarding the ‘Sheshadri’s Silver Oak’ project at Boduppal in Medchal–Malkajgiri district. She said she had paid ₹54.2 lakh, but no construction work began despite repeated commitments from the developer. TGRERA ordered the promoter to refund the amount with 10.75% interest from November 5, 2022, until repayment, within 30 days.
These actions highlight the authority’s enforcement of provisions under the RERA framework to safeguard homebuyers’ interests. TGRERA has repeatedly emphasized that delays, non-registration of projects, and non-disclosure of key details constitute violations under the Act, and penalties are applicable to ensure accountability in the sector.
