The Haryana government has stepped up its actions against the illegal construction and subsequent business usage of the residential units in the high-end Phases 1 through 5 of the DLF area of Gurugram, as a revised list says a total of 4,565 properties do not conform to the standards of construction approved in the area. Based on the orders of the Punjab and Haryana High Court, a joint notice has been issued by the Department of Town and Country Planning (DTCP), giving home owners until January 16, 2026, to lodge their objections against the orders issued.
As per reports, this is in the wake of a new survey, as mandated by the court, carried out by the enforcement wing of the DTCP. The previous survey had identified 4,183 plots and houses for violations, and this new survey identified another 382 properties for violating the approved plans as well as carrying out their business activities from residential properties.
Public Notice Posted for Transparency
The list has been publicly advertised in detail and is available on the government portal of the department, tcpharyana.gov.in, where any owner can check whether they are in this list. This has been said to ensure that no citizen is punished without being heard by relaunching this notice. This has been done to ensure that no citizen faces any penalty without being heard.
The property owners, in case they disagree with the results, have been asked to make their objections in writing to the District Town Planner (Enforcement), Gurugram, on or before the stipulated date. The objections need to be accompanied by documentary proof in the form of sanctioned plans for buildings, Br-III approvals, occupation certificates, photographs supporting the objection, and contact information. The authorities have clarified in no uncertain terms that objections received after January 16, 2026, would not be considered.
Role of Judicial Intervention Behind the Exercise
The enforcement of this drive is a result of an examination of previous actions taken by the town planning department. This is owing to a statement on October 28 that was made when the Supreme Court stated that certain homeowners who had been influenced in previous cases had neither been parties to that particular case nor had they had an occasion to present their side of the argument.
On November 26, the High Court after this event instructed the Haryana government and the DTCP to issue a detailed public notice and to reply all the objections within the time limit. Besides, they were given another directive to send a report based on their survey of the objections till January 16. The subsequent hearing in this case will be on January 30, 2026, when the DTCP is expected to present its findings and suggestions to the High Court. Pointing to Illegal Construction and Commercial Use
In this respect, it has been reiterated that illegal building and the commercial use of the residential properties without proper authorization constitute a blatant violation of the Haryana Development and Regulation of Urban Areas Act. Besides, this leads to the deterioration of civic infrastructure and unplanned urbanization. DLF Phases 1 to 5, the oldest and one of the most luxurious residential societies of Gurugram, has been witnessing the increase of unauthorized floorings, illegal alterations to the structures, and also the changes of the residential units into offices, guest houses, and other commercial ventures, among the rest. Consequently, the resident welfare associations have been raising their voices in protest against the issues of overcrowding, lack of parking, safety, etc.
What Lies Ahead
It has been maintained that further action, be it in terms of punishment or sealing or demolishing these structures, will be done as per the directions of the court after due process is over. This exercise, as has been maintained, is not for indiscriminate action but efforts towards ensuring compliance with the Planning Act while, at the same time, respecting the rights of the property holders. With the deadline to raise objections fast-approaching, the results of this exercise are also likely to have profound repercussions for governance and enforcement in the residential sectors of Gurugram.
