Telangana RERA Orders SK Constructions to Resolve Structural Issues and Fulfill Promised Amenities
The Telangana Real Estate Regulatory Authority (TRERA) has issued a directive to SK Constructions, led by B.R. Mohan Reddy, to address complaints regarding unfulfilled amenities, structural concerns, and the lack of a Manjeera water connection at Padmasreekar Icon, a residential project in Gajularamaram, Hyderabad. The decision follows complaints filed by residents who claimed that the developer failed to deliver on several commitments despite collecting charges for these facilities.
A group of flat owners, including B.M. Vamshi Krishna and Racha Naveen Kumar, approached RERA with grievances about the project. They alleged that the builder did not provide promised amenities such as a play area, gym, and multipurpose hall, even after collecting Rs 3 lakh per unit as an amenities charge. In addition to these issues, the residents reported an extra charge of up to Rs 10,000 per unit for a drinking water supply that was never arranged.
During the hearings, SK Constructions denied the allegations, stating that the amenities and project specifications were provided as per the agreement and brochure. The builder argued that the play area, gym, and multipurpose hall were not included in the original sanctioned plan but were later developed at the request of residents. Furthermore, the developer contended that the responsibility for arranging the Manjeera water connection rested with the residents themselves and not the company.
RERA, after considering the complaints, ordered a technical inspection of the project. The inspection report confirmed several deficiencies, including:
- Absence of a drinking water connection.
- Structural issues such as water leakage and deteriorating terrace waterproofing.
- Cracked walls and poor-quality drainage systems.
- Lack of security peepholes in apartment doors.
- Water seepage problems.
These findings validated the concerns raised by the residents and led to further action by the regulatory body.
Following the inspection, RERA instructed SK Constructions to rectify the identified structural issues and ensure the provision of the Manjeera water connection as originally promised. However, regarding the disputed amenities, the authority noted that while the builder had advertised them, they were not explicitly mentioned in the agreement or the sanctioned plan. As a result, residents could not legally claim them as a right.
The directive is expected to provide some relief to the affected residents, ensuring that at least the essential issues related to water supply and structural integrity are addressed. Meanwhile, the ruling also sets a precedent for other similar cases where homebuyers face challenges due to incomplete or misleading project specifications.
